GENERAL TERMS AND CONDITIONS (GTC) FOR HUNTING TRIPS

FAIR HUNT e.U. is a licensed travel agency that arranges individual hunting trips. The general travel conditions (ARB 1992) in their latest version (recommended by the advisory board of the Federal Ministry of Health, Sports, and Consumer Protection, in accordance with § 73 para. 1 of the Industrial Code 1994 and § 8 of the Ordinance of the Federal Minister for Economy, Family, and Youth in the 1994 version on the operating regulations for the travel agency industry) apply to trips with FAIR HUNT e.U. (hereinafter referred to as FAIR HUNT).

Hunting trips are subject to special conditions that partially differ from general tourism conditions. The following deviations apply:

1) CONTRACT

By signing the hunting contract, you commission us with the planning and organization of your hunting trip. By signing, you also confirm that you have read and accepted the general terms and conditions. You can withdraw from this contract at any time, subject to the cancellation terms stated in the contract.

To ensure all necessary formalities for the trip—such as visas, firearms licenses, hunting and shooting licenses, and the like—can be completed in a timely manner, the documents requested by us, such as passports, passport photos, firearms data, and the like, must be received by us at least 30 days before the start of the trip, unless otherwise agreed. If these documents are not received on time, we can no longer guarantee the proper organization of the hunting trip you have booked. If this period is not adhered to, any additional costs incurred or resulting cancellation fees must be borne by the customer.

2) SERVICES

The scope of services is clearly defined in the offer, which forms the basis of the contract. Deviating agreements with our local partner or third parties cannot be recognized or enforced.

3) PAYMENT TERMS

The payment terms are specified in the contract. The deposit due upon signing the contract amounts to a maximum of 20% of the estimated total costs. The remaining payment is made exclusively after the hunt! If the deposit does not arrive on time despite the grace period, you will not be entitled to receive the travel documents. In this case, the trip is considered canceled. All associated costs must be borne by the customer.

 

4) LIABILITY

The traveler is aware that the hunting trip arranged is not comparable to other vacation trips. Hunting trips are journeys with special risks (expedition character). The hunting provider is not liable for consequences arising from such risks if they occur outside of its duty. We cannot assume liability for damages to your health or your equipment, provided that no fault lies with us. We are not liable for accidents, loss of luggage, damage, delays, damages, and expenses due to force majeure. This includes, in particular, hunting and traffic accidents, strikes, delays, political unrest, war, and natural disasters.

The hunting trips organized or arranged by us take place in the wilderness. The hunting areas are subject to a variety of uncontrollable uncertainties, weather conditions, the behavior of the game, the current feeding situation, etc. Therefore, there may be comfort deficiencies in the hunting trip that FAIR HUNT cannot influence, for which FAIR HUNT is not liable. The liability of FAIR HUNT for accidents when using hunting grounds and means of transportation in the hunting area is excluded. We cannot assume liability for the desired hunting success or the desired trophy strength—there is also no claim for a reduction or refund of the travel price.

5) DUTIES OF THE HUNTING GUEST

The traveler is responsible for complying with official regulations, particularly passport and customs regulations, as well as international agreements on species protection. The hunting guest is obliged to ensure they have international hunting liability insurance. They must also observe the hunting laws of the respective hunting country and follow the instructions of the stalking guide. Violations or hunting while intoxicated may lead to the termination of the hunt or exclusion from the hunt. The hunting guest is always responsible for their own shot. When the stalking guide authorizes a shot at a piece of game, it merely means that you are allowed to shoot it. It is your decision whether you actually want to shoot it. If you decide to shoot, you bear all the consequences—including misses, wounding, and the trophy size (exceptions to the trophy size are possible but must be stated in the contract).

6) HUNTING PROTOCOL

The only recognized basis for the final invoice is the hunting protocol. The hunting protocol must be written in both German and the local language. This protocol must include all services rendered and all game taken. By signing, you confirm the accuracy of the information listed in the hunting protocol.

7) FINAL INVOICE

The final invoice is based on the hunting protocol signed by you. The invoice amount is due immediately upon receipt of the invoice and can be paid in cash at the end of the trip on site, or after your return to your home country to FAIR HUNT.

 

8) COMPLAINTS

The hunting protocol is the only recognized basis for any complaints. Complaints must be reported immediately on site and documented (entered into the hunting protocol). Complaints not entered into the hunting protocol cannot be recognized. Complaints must be made in writing within 30 days after the end of the trip.

9) TROPHIES

The trophies remain the property of the respective local hunting provider until full payment is received. Unless otherwise explicitly agreed in writing, the trophies will only be delivered after full payment of the hunting and trophy fees as well as any fees for shipping and import customs clearance. The customer is responsible for the transport of the trophies to their home country. We cannot assume liability for damage to your trophies due to improper handling, nor for breakage, damage, or loss of your trophies during transport or shipping.

11) WITHDRAWAL BY THE ORGANIZER

We reserve the right to withdraw from the contract at any time if unforeseen circumstances, such as force majeure (acts of war, terrorism, strikes, unrest, natural disasters, etc.), jeopardize the proper execution of the booked trip. The same applies if the minimum number of participants specified in the offer is not reached. If we cannot offer you a corresponding alternative, all advance payments will be refunded in full.

12) PREMATURE TERMINATION OF THE TRIP

If a trip is prematurely terminated by the customer for any reason attributable to them, the full travel price must always be paid. An exception to this rule applies to hunting trips to Hungary, where only the services actually consumed will be billed. For all other countries, if the trip is prematurely terminated, any additional costs for ticket rebooking, extra transfers, hotel costs, and the like must be borne by the customer.

13) CUSTOMER MONEY PROTECTION

FAIR HUNT e.U. (business owner KURT HOFER) is registered under GISA number 25600056 in the organizers’ directory of the Federal Ministry for Digitalization and Economic Location. According to the travel agency security ordinance (RSV), customer funds for package tours of the organizer FAIR HUNT e.U. are secured as follows (valid from 1.1.2023):

The limited security variant (https://www.bmdw.gv.at/Unternehmen/Reiseveranstalter/Seiten/default.aspx) covers the entire revenue that the company generates from organizing package tours and offering associated travel services.

14) FORCE MAJEURE

If at the time of booking, due to unforeseen reasons such as war, unrest, terrorism, epidemics, strikes, natural disasters, fuel shortages, or similar, the trip must be canceled or changed, all associated costs must be borne by the customer.

15) JURISDICTION

Contracts concluded under the above terms and conditions are subject to Austrian law. Vienna is agreed upon as the place of jurisdiction.

16) MISCELLANEOUS

Our offers do not include insurance. We strongly recommend taking out appropriate travel, cancellation, and luggage insurance, which we can gladly offer you. We assume no liability for damages caused by the hunting guest themselves, the local hunting provider, or other service providers. All programs and conditions listed on the homepage refer to the status as of January 1, 2013, subject to typographical errors.
